This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the Goods (Goods) listed on our website and those of our partners to you. Please read these terms and conditions carefully before ordering any Goods from our site. You should understand that by ordering any of our Goods, you agree to be bound by these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Goods from our site.
This site is operated by E-Cuisine Limited (we). We are registered in England and Wales under company number 6318186 and with our registered office at Lealta House, Blackpool Business Park, Blackpool, Lancashire, FY4 2RP
Our site is only intended for use by people resident in those areas specified in our website.
By placing an order through our site, you warrant that:
(a) You are legally capable of entering into binding contracts; [and]
(b) You are at least 18 years old.
(c) If you are purchasing alcohol and appear to be under the age of 21 you will be required to prove that you are over 18. Only the following froms of I.D. will be accepted: Passport, Photo Driving License.
4.1 After placing an order, you will receive an e-mail or SMS message from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail or SMS message that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.
4.2 The Contract will relate only to those Goods defined within your order whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Goods which may have been part of your order until the dispatch of such Goods has been confirmed in a separate Dispatch Confirmation.
5.1 You will not have any right to cancel an order once accepted by us.
6.1 Our goal is to deliver on-time i.e. delivering at the time we quote. Unfortunately factors, such as, weather and traffic conditions occasionally prevent us from achieving this.
7.1 Payment for all Goods must be by credit or debit card as specified in our website.
7.2 If we have to issue a refund to you, we shall try to do so within 7 – 10 days.
8.1 Our liability for failing to deliver Goods of satisfactory quality or otherwise breaking this contract is limited to the price of those Goods.
8.2 Any complaints relating to the failure to deliver goods or unsatisfactory quality of the product should be directed to customerservices@ecuisine.tv or call 0870 241 4970 between 9:00am and 5:00pm Monday to Friday within 24 hours of receipt of goods.
8.3 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
8.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage.
8.5 If you have an allergy or other aversion, for example, to nuts you must enquire before placing an order. Some dishes may contain nuts. Some Goods may contain bones or other naturally occurring items arising from organic material.
9.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.
10.1 These terms and conditions represent the entire agreement between us.
10.2 All content included on this interactive service, such as text, graphics, button icons, images and software, is used by us under license from Brett Technologies (Holdings) Limited and is protected by UK and European copyright laws.
10.3 Any use of the content and software on this interactive service including the reproduction, modification, distribution, transmission, republication, display or performance, of the content on this interactive service is strictly prohibited.
10.4 SMS Messaging - You are responsible for providing and maintaining a cellular phone and ensuring connection to a cellular network capable of receiving the SMS Services.
You confirm that you are the owner or legitimate user, or that you have the consent of the owner or legitimate user, of the cellular phone you are registering for the SMS Services.
You acknowledge that the SMS Services may, at any time, be adversely affected by problems with your cellular phone network, including, without limitation, interference to the network coverage. E-Cuisine shall not be responsible or liable to you for any loss, damage or expenses incurred directly or indirectly by you as a result of any difficulties experienced by your cellular phone service provider.

11.1 E-Cusine partners with Bring A Drink who are responsible for the provision of the alcohol sale and its delivery service.
11.2 All transactions are at our discretion and we are not obligated to give any reason if service is refused.
11.3 If you appear to be under the age of 21 years old you will be required to prove that you are over 18. Only the following forms of I.D. will be accepted: Passport, Photo Driving Licence
11.4 Some personal details will be stored on our system (name, address, tel, D.O.B, email). Your card details will never be stored electronically and all personal details are stored safely in accordance with the data protection act.
11.5 We will not serve you if we believe you are excessively drunk.
11.6 We will not serve you if we believe that alcohol will be passed to under 18’s.
11.7 The cardholder must be present at the delivery address and only they can collect the delivery.
11.8 You will be contacted on the number given as the driver arrives with your order so please be ready to accept your delivery.
11.9 Orders can only be given to members so please have your membership number and I.D. to hand.
